In many cases there will be financial matters that may need to be resolved as part of a divorce. It is important to consider the full picture not only financial but also non-financial too. We advise in relation to assets such as the family home or properties, all types of pensions through to businesses and issues with regard to Trusts. At Barrett & Co we work closely with colleagues and other professionals to ensure you are fully advised as to your personal circumstances.

Consideration should be made as to how you wish to deal with your financial circumstances and please see the link to Resolving Family Disputes for the various options open to you.

It is important to be aware that, where there are outstanding financial matters, it is often sensible to record how any assets are to be shared. If it is possible to agree a settlement voluntarily then it is sensible to record this agreement into a document known as a Minute of Consent Order. For this to become a binding document, it is important that a District Judge considers and approves such an Agreement. A Judge can consider any draft Orders as part of a divorce or dissolution of a civil partnership post the date of Decree Nisi (Marriage) or Conditional Order – Dissolution (Civil Partnership).

Quite often, where there is a dispute between parties’ and where they seek advice from their Solicitors, financial information will need to be exchanged between the parties. All parties’ have an ongoing duty to provide full, frank and transparent disclosure of all their circumstances including assets held abroad.

Whether by way of voluntary exchange, Court application, mediation or collaborative law – all parties are encouraged to try to negotiate to reach a settlement but it is important that you fully consider each of the processes available to see if one suits your needs more than the other.

From experience, it is again worth stressing that, in order to avoid huge conflict and tensions between you and your ex-partner/spouse, proper consideration is given to minimising those conflicts, especially where there are children involved, but even when there are not, the collaborative process can assist client’s greatly in achieving this aim.

  • 5 star review  When informed by your employer that your employment contract is to be terminated because of a restructuring and not through any fault of one’s own – and probably not knowing what to do or who to turn to - it’s a lonely, disorientating, and unsettling place to be - as anyone in a similar position reading this will fully understand. When this happened to me, I didn’t know who to turn to. But a colleague recommended Barrett and Co, and so I checked out the website and was impressed with what I read about Justin Sadler and his experience. Justin and his assistant were quick to respond to my inquiry, and a consultation call was set up which was extremely useful. Justin quickly grasped my situation and was able to provide me with sensible and pragmatic legal advice as well as a tactical approach on how to proceed, and very importantly - advice on how to best channel my feelings. I had a legal stalwart in my corner. In short, we achieved as good an outcome as was possible in the circumstances and I am very grateful to Justin for all his help and advice. If you need employment related legal advice - look no further than contacting Justin Sadler at Barrett and Co.

  • 5 star review  In the run up to completion, Emma and her colleagues were taking very good care of us. Despite many challenges throughout the day, including a tricky chain + backlog in banking transactions, Emma was always on hand with a friendly word and answering our queries quickly and professionally etc.
