You may wish to consider a pre-nuptial or pre-marital contract for various reasons; for example, if you have various assets that you are bringing into the marriage that you want to protect, or where there is a clear disparity between the assets that you and your fiancée separately own. The pre-nuptial or pre-marital contract would act as a contract and would need to be entered into on the basis that each party has provided the other with full, frank and transparent disclosure of all their relevant financial and other circumstances; that they have obtained independent legal advice and that they have entered in to the Agreement or contract well in advance of their wedding date (ideally at least 3 to 4 weeks before). Such agreements are not presently enforceable or indeed binding upon a matrimonial Court as part of any subsequent divorce proceedings but they can be an important document evidencing the parties wishes at the time they are contemplating marriage and dealing specifically with how they wish their assets be shared upon the unfortunate breakdown of that marriage.
