The Private Client Team prepares for Will Aid 2017

Barrett and Co is once again participating in Will Aid this year; last year the firm raised £5,260 and were named as top donating solicitors for a small law firm. The firm is proud to be taking part in the scheme again this year and the Department has already scheduled around 30 appointments during the month of November. They hope to meet many new clients during the course of the month as well as helping to raise valuable funds to support this worthwhile cause.

In a recent case (Sparks v Biden), Mr Sparks owned land that was suitable for residential development. Mr Biden, a developer entered into an agreement with Mr Sparks to start the development. The agreement was to grant Mr Biden an option to buy the land and he would have to use all reasonable endeavours to obtain planning permission. Once planning was granted Mr Biden was under an obligation to build as soon as possible.

New Debt Collection Protocol - A Focus on Settlement

On 1st October 2017, a new debt collection pre-action protocol will come into effect in England and Wales. The protocol, the first of its kind specifically for debt claims, will apply to consumer debts disputes where a business is claiming debt repayment from an individual. Debts claimed by public bodies will also be covered, as will debts involving sole traders, both as creditors and debtors. Business to business debts, are not covered by the protocol.
