Only in the rarefied air of Westminster would the idea of introducing a 275 page Bill to “open up new opportunities for small business” produce anything other than surprise (and frustration).

The Reynolds Report - The only constant thing is change......nonetheless, this is what happened with the Small Business, Enterprise and Employment Act 2015 (“SBEEA 2015”) which received Royal Assent on 26 March 2015.

SBEEA 2015 makes provisions on a surprisingly broad range of issues including:

  • Public sector procurement;
  • The regulation of relations between tied pub tenants and their landlords;
  • Childcare;
  • The evaluation of education; and –even
  • Concessionary coal.

To make life even more complicated its provisions have been progressively drip-fed into effect since enactment.  

The latest tranche of provisions – which include the requirement on UK companies to create a Register of Persons with Significant Control (“PSC’s”) – was brought into effect on 6 April 2016 by the Small Business Enterprise and Employment Act 2015 (Commencement No 3) Regulations 2015.  Further elements – such as the requirement to file the information on the PSC Register with Companies House and the replacement of the annual return with the new “confirmation statement” - come into force in June.

SBEEA 2015 also:

  • Makes changes to Employment Law: providing enhanced protection for whistle blowers, changes to Employment Tribunal procedure and restrictions on the enforceability of exclusivity terms in zero hours contracts;  and
  • Modifies director’s disqualification provisions and the powers and regulation of insolvency practitioners.
